(Florida Building Code, 105.9 Asbestos Notification Statement)
A thorough asbestos inspection performed by a licensed asbestos consultant is required before demolition* or renovation of commercial and institutional structures and buildings**. If asbestos is identified in the asbestos survey, and is expected to be disturbed in any way, a State licensed asbestos contractor in accordance with all Federal, State and County regulations must remove it. Additionally, a notification must be sent to the proper authority: Asbestos Notification Requirements.
By signing the “Application and Permit for Construction”, you certify that you have complied, or will comply with all Federal State and County laws and regulations pertaining to asbestos removal. By your signature you are also certifying that you understand the requirements stated in the above paragraph, and further understand that there may be additional requirements within these rules, which also apply to you. You further understand that any violations of these requirements can result in monetary penalties to the building owners, building lessees, and their respective contractors. Additional penalties for failing to comply with asbestos rules may include criminal prosecution under federal law and contractor license forfeiture/suspension under State law.
*The definition of demolition includes removal of a load bearing structure.
** One (1) single-family residential home, or an apartment building with four (4) dwellings or less, is typically exempt from specific environmental asbestos requirements. This exemption is voided if the aforementioned structure is part of a larger project. Please contact Pinellas County, Air Quality Division to verify if your project or structure meets this exemption.
